A Sacramento man was killed by a car on the Capital City Freeway, also known as Business 80. The name of the man, who died after being by two cars, has not been released.  He was described only as a 50 year old caucasian man.  The police indicate that he was hit by a white Toyota at around 1 a.m. Monday morning as he was crossing the freeway between Marconi and El Camino Avenues. The driver of the Toyota stopped and while calling for help, the man was hit by another car.

Although we do not know all the details about this Sacramento pedestrian injury accident, it appears the pedestrian was at fault.  It is not clear why he was crossing the freeway  Investigators have not said whether drugs or alcohol were involved. California Vehicle Code §21950 says: “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection.” That section also states that the driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk “shall exercise all due care and shall reduce the speed of a vehicle or take any other action relating to the operating of the vehicle as necessary to safeguard the safety of the pedestrian.”  In this particular case, it appears the driver of the Toyota could not avoid this collision.
