A student of Beitzel Elementary School suffered major injuries on Thursday afternoon while he was run over by a FedEx truck as he was leaving the school.

The truck was in the front of Beitzel Elementary School at around 1:30 keeping the crosswalk blocked. While the delivery truck turned left onto westbound Chantal Way, the 10-year-boy ran onto the crosswalk. He ran directly into the truck and additionally ended up being pulled to the ground, after that was run over by the vehicles back wheels.

The victim was brought to UC Davis Medical Center having significant injuries, which include a broken pelvis. Sacramento accident remains under investigation.

In all pedestrian versus car collisions, witness accounts are essential. However there may be other information that can influence who will be deemed responsible, in whole or in part, for a collision. California Vehicle Code section 21950 says: “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection”, and that a driver approaching a pedestrian within any marked or unmarked crosswalk “shall exercise all due care and shall reduce the speed of a vehicle or take any other action relating to the operating of the vehicle as necessary to safeguard the safety of the pedestrian.” Determining who is at fault in a pedestrian versus auto collision usually requires a very fact specific investigation that includes consideration of the speed of the vehicle, the visibility of the pedestrian, road conditions, and whether avoidance measures were taken.

The driver of a vehicle can be held legally liable for injuries to a pedestrian even if they were not in a cross walk at the time they were hit. Pedestrians injured by a motor vehicle should seek the counsel of an experienced Sacramento Injury Attorney who will analyze all of the factors involved in an incident and will hold the negligent parties accountable. If roadway conditions were a factor, a public or governmental entity may have liability. It is important to consult with a California Personal Injury lawyer quickly since any claim against a public or governmental agency must be filed within 180 days of the accident or injury. An experienced personal injury attorney will advise injury victims of their rights, including whether they are entitled to recover medical expenses, lost income and pain and suffering as a result of the incident.

The driver of a Yuba Sutter garbage truck died Tuesday in a Marysville accident on Highway 20 after his truck crashed with a big rig. Yuba City resident Gary Wayne Mathis, 43, was pronounced dead at the scene. The driver of the big rig was transported to a local hospital with minor injuries. The cause of the accident is not known and this Marysville big rig accident remains under investigation.

Big Rigs represent a unique danger on our roadways. According to the National Highway Traffic Safety Administration (NHTSA), 5,374 people were killed during 1998 in collisions involving large trucks. In those fatal collisions, 86 percent of the victims were either occupants of the other vehicle or wee not in any vehicle. Because of their size, big-rigs represent an especially dangerous threat on the roadways. In many instances, the conduct of the big-rig driver and/or their employer can greatly increase the risk of the general motoring public. Statistics show that many of the big-rig collisions resulting in injury or fatality are caused in part by the following:

Truck driver             fatigue caused by driving long hauls while failing to comply             with minimum sleep and continuous driving regulations;

Use of drugs             by drivers to assist in driving long hours and for             recreation and failure to maintain an effective drug testing             program;

Failure to             maintain the tires, brakes and other mechanical conditions             of the tractors and trailers through minimum required             inspections;

Trucks with             loads that over the weight limit or that are subject to             shifting due to improper balance or lack of restraint;

Excessive             speeding and other driving violations often ignored by the             employer;

Lack of training and minimum experience requirements.

Truck driver             fatigue caused by driving long hauls while failing to comply             with minimum sleep and continuous driving regulations;

Unfortunately, the victims of a big-rig or truck collision or their families often have a difficult time obtaining fair compensation because they are dealing with commercial insurance carriers that got to great lengths to avoid payment of claims. Injured victims or the family of a deceased victim are urged to obtain the legal assistance of An experienced Personal Injury Attorney, who will investigate the causes of the collision, protect the injured person’s legal rights, and make sure that they receive adequate compensation for all of the consequences of their injuries.

Sacramento Trucking Accident Attorneys

Work injuries present a set of complicating factors to the claims process. Most work injuries are covered by the workers’ compensation system that has its own set of rules. Under workers’ compensation, an employee is entitled to certain benefits including medical expenses, temporary disability for time missed from work, and permanent disability based on the extent of the injury. These benefits are paid by insurance obtained by the employer. Workers’ compensation provides coverage regardless of who was at fault for causing the injury. In most situations, the workers’ compensation system is the “exclusive” remedy for the injured worker against his/her employer, meaning that the worker must accept what is offered by workers’ compensation and cannot sue his or her employer for civil damages.

In a situation where someone other than the employer is responsible for causing the injury, an injured worker is entitled to recover civil damages in addition to workers compensation benefits. The compensation an injured worker receives under a civil claim includes many things that cannot be recovered under a workers’ compensation claim, including pain and suffering, and can result in a much bigger recovery to the injured worker. Accordingly, a thorough investigation should be performed any time a worker is seriously injured on the job to determine who was entirely or partially at fault. Anyone seriously injured in a work accident should a qualified Northern California Personal Injury Attorney to investigate the case and determine all of the available legal options.

At about 3:20 p.m. a one ton Chevy pickup pulling a trailer loaded with rock and debris was travelling southbound on Auburn Boulevard approaching College Oak Drive when the Ford F10 pickup, driven by 92-year-old man, attempted to turn left onto College Oak. The Chevy hit the smaller Ford on the passenger side and it turned over on the driver’s side. Unfortunately, the female passenger of the Ford was declared dead at the scene and the driver was taken to Mercy San Juan Medical Center with major injuries. Initial reports from the police indicate the driver of the Ford turned left against a red light, although this Sacramento injury accident remains under investigation.

Nothing is more devastating than losing a loved one, especially if it is unexpected and as the result of someone’s negligence. The law provides that certain family members, usually a spouse, child or parent, have the right to recover compensation for certain losses if someone is liable for causing another person’s death. These losses include both economic and non-economic damages. The most significant economic loss recoverable in a wrongful death claim is typically the loss of financial support and other benefits that the deceased would have provided in his or her lifetime to the person making the claim. Other damages include the loss of love, support and companionship of the deceased person.

Anyone seriously injured in an auto accident has a number of serious issues to deal with after a collision like this. First, legal responsibility for the collision must be determined, which sometimes requires investigation beyond what is contained in the police report. Second, the medical bills must be paid. Even if there is health insurance to pay for the bills initially, the health insurance company will likely seek reimbursement from any insurance recovery. That means that the health insurance company will be competing for money that otherwise would go to the injured victim. Third, when there are multiple people injured in a crash, they will often be competing for a proportional share of a limited amount of insurance money. Lastly, insurance companies will do whatever they can to avoid paying fair compensation for not only medical bills, but lost income and pain and suffering as well.

Three people suffered major injuries this morning when the SUV they were driving became disabled in the slow lane on northbound Highway 99 and was hit from behind by a big rig. The big rig plowed the SUV into a sound wall on the shoulder, crushing the SUV in the process. Two occupants of the SUV were ejected and a third person was trapped inside. All three victims of the Highway 99 accident were transported to the hospital in critical condition.

Although this California injury accident remains under investigation, the information available indicates that traffic had been backed up as a result of the disabled vehicle, and therefore the driver of the big rig would be primarily at fault for causing this collision by violation Vehicle Code §22350, driving at a speed that was unsafe for traffic conditions.

Big Rigs represent a unique danger on our roadways. According to the National Highway Traffic Safety Administration (NHTSA), 5,374 people were killed during 1998 in collisions involving large trucks. In those fatal collisions, 86 percent of the victims were either occupants of another vehicle or not in any vehicle.

Truck driver           fatigue caused by driving long hauls while failing to comply           with minimum sleep and continuous driving regulations;

Use of drugs           by drivers to assist in driving long hours and for recreation           and failure to maintain an effective drug testing program;

Failure to           maintain the tires, brakes and other mechanical conditions of           the tractors and trailers through minimum required           inspections;

Trucks with           loads that over the weight limit or that are subject to           shifting due to improper balance or lack of restraint;

Excessive           speeding and other driving violations often ignored by the           employer;

Lack of training and minimum experience requirements.

Truck driver           fatigue caused by driving long hauls while failing to comply           with minimum sleep and continuous driving regulations;

Unfortunately, the victims and their families of a big-rig or truck collision often have a difficult time obtaining fair compensation, sometimes because the trucker is from out of state and the insurance company is an obscure commercial carrier with experience in avoiding payment of claims. Injured victims or the family of a deceased victim are urged to obtain the legal assistance of An experienced Personal Injury Attorney, who will investigate the causes of the collision, protect the injured person’s legal rights, and make sure that they receive adequate compensation for all of the consequences of their injuries.

One person died and five were seriously injured Wednesday in a big rig accident on Highway 99 in Modesto. At approximately 1:50 p.m., a big rig traveling south bound failed to slow for traffic ahead and struck a Nissan Frontier from behind, triggering a five vehicle chain reaction collision. The male driver of the Nissan Frontier was pronounced dead at the scene. His female passenger was taken to a local hospital with major injuries. Four people in other vehicles also sustained injuries.

California Truck Accidents

Rear end collisions are the most common type of injury accident. Traveling at an unsafe speed or simply not paying attention are the most common causes. If the driver of a vehicle pays attention to traffic conditions, drives at a safe speed, and maintains a safe distance behind the vehicle ahead, these collisions are easily avoidable. In almost every situation, the vehicle that hits another vehicle from behind has violated California Vehicle Code §22350, and is legally responsible for causing the collision.

There is a common perception that these type of collisions are merely accidents, are forgivable, and that victims too often try to take advantage by claiming compensation for whiplash. However, the reality is that these collisions can and do cause major catastrophic injuries and, as this collision illustrates, death. This is especially true when the vehicle causing the rear end collision is a big rig.

According to the National Highway Traffic Safety Administration (NHTSA), 5,374 people were killed during 1998 in collisions involving large trucks. In those fatal collisions, 86 percent of the victims were occupants of another vehicle. Because of their size, big-rigs represent an especially dangerous threat on the roadways. In many instances, the conduct of the big-rig driver and/or their employer can greatly increase the risk to the general motoring public. Statistics show that many of the big-rig collisions resulting in injury or fatality are caused in part by the following:

Truck              driver fatigue caused by driving long hauls while failing to             comply with minimum sleep and continuous driving             regulations;

Use              of drugs by drivers to assist in driving long hours and for             recreation and failure to maintain an effective drug testing             program;

Failure              to maintain the tires, brakes and other mechanical             conditions of the tractors and trailers through minimum             required inspections;

Trucks              with loads that over the weight limit or that are subject to             shifting due to improper balance or lack of restraint;

Excessive              speeding and other driving violations often ignored by the             employer;

Lack of training and minimum experience requirements.

Two people were killed in a Modesto car accident involving a big rig on October 20, 2010. The fatal accident happened on Highway 99, south of North Carpenter Road at around 2 p.m. Early reports indicate the truck jack-knifed and crushed a pickup truck. The Modesto truck accident remains under investigation although t alcohol and drugs are not believed to be factor. It is unknown what may have caused the trucker to lose control of his big-rig.

We are sending our deepest condolences to the families of the deceased victims. It is indeed a tragic lose.

Modesto Auto Accident Statistic Attorneys

According to the National Highway Traffic Safety Administration (NHTSA), 5,374 people were killed during 1998 in collisions involving large trucks. In those fatal collisions, 86 percent of the victims were occupants of another vehicle or not in any vehicle.

Truck driver           fatigue caused by driving long hauls while failing to comply           with minimum sleep and continuous driving regulations;

Use of drugs           by drivers to assist in driving long hours and for recreation           and failure to maintain an effective drug testing program;

Failure to           maintain the tires, brakes and other mechanical conditions of           the tractors and trailers through minimum required           inspections;

Trucks with           loads that over the weight limit or that are subject to           shifting due to improper balance or lack of restraint;

Excessive           speeding and other driving violations often ignored by the           employer;

Lack of training and minimum experience requirements.

The drivers of a Sacramento County transit bus and a big rig were seriously injured in a Sacramento auto accident and San Joaquin County auto accident that occurred on State Route 12 near Isleton around 4:40 p.m. on Monday. According to the California Highway Patrol, the big rig was headed west bound at an unknown rate of speed when it encountered traffic, attempted to slow down and jackknifed. Thetransit bus, which was not carrying passengers, was traveling east bound when it collided with the out of control big rig. The driver of the bus was transported by life flight to the U.C. Davis Medical Center and the big rig driver was taken to John Muir hospital in the Bay Area, both with major injuries.

This California auto collision also involved a red Chevy Blazer which swerved and went down an embankment to avoid the collision. Reports indicated that the occupants of the Blazer were not seriously injured.

The California big rig accident remains under investigation. It is not reported that alcohol and drugs were involved.

Although this California big rig injury accident is still under investigation, it appears that the driver of the big rig was at fault for operating her truck at a speed that was unsafe for the prevailing traffic conditions, a violation of Vehicle Code §22350. Big-rigs have the potential to be especially dangerous to the general motoring public. The conduct of the big-rig driver and/or their employer can greatly increase the risk of causing a collision and injuries. Statistics show that many of the big-rig collisions resulting in injury or fatality are caused in part by the following:

Truck              driver fatigue caused by driving long hauls while failing to             comply with minimum sleep and continuous driving             regulations;

Use              of drugs by drivers to assist in driving long hours and for             recreation and failure to maintain an effective drug testing             program;

Failure              to maintain the tires, brakes and other mechanical             conditions of the tractors and trailers through minimum             required inspections;

Trucks              with loads that over the weight limit or that are subject to             shifting due to improper balance or lack of restraint;

Excessive              speeding and other driving violations often ignored by the             employer;

Lack of training and minimum experience requirements.

Truck              driver fatigue caused by driving long hauls while failing to             comply with minimum sleep and continuous driving             regulations;

Use              of drugs by drivers to assist in driving long hours and for             recreation and failure to maintain an effective drug testing             program;

Failure              to maintain the tires, brakes and other mechanical             conditions of the tractors and trailers through minimum             required inspections;

Unfortunately, the victims of a big-rig or truck collision often have a difficult time obtaining fair compensation, sometimes because the trucker is from out of state and the insurance company is an obscure commercial carrier with experience in avoiding payment of claims.
Four people died Thursday morning in an accident involving two big-rigs on state Highway 12 east of Kirkland Ranch Road, near American Canyon. A tractor trailer big-rig was traveling west bound on the two lane highway behind a Subaru Forester when traffic began to slow to a stop. The big rig rear ended the Subaru and pushed it into the opposing lane of traffic directly in the path of an east bound big-rig.The east bound big-rig struck the car head on and pushed it about 200 feet before coming to a stop. CHP reported that all four occupants of the Subaru were declared dead at the scene. According to the CHP, the Subaru’s driver was 48-year-old Matthew Jay Smith of Ashland, Oregon, his daughter 19-year-old Laura Smith, and his parents, 80-year-old Richard Smith and 74-year-old Sally Smith.

Trucks with loads that over the weight limit or that are subject to shifting due to improper balance or lack of restraint;

Excessive speeding and other driving violations often ignored by the employer;

Lack of training and minimum experience requirements.

In the above scenario, the big-rig that struck the Subaru from the rear violated Vehicle Code §22350 and possibly other regulations, and is legally responsible to the families of the victims for wrongful death damages, including funeral expenses, an loss of income or support, as well as loss of love, affection and companionship. Unfortunately, the victims of a big-rig or truck collision often have a difficult time obtaining fair compensation, sometimes because the trucker is from out of state and the insurance company is an obscure commercial carrier with experience in avoiding payment of claims. Injured victims or the family of a deceased victim are urged to obtain the legal assistance of a Personal Injury Attorney, who will investigate the causes of the collision and protect their legal rights to be compensated appropriately.

One of the last things parents worry about when dropping their children off at school or a daycare center is that the school itself will be hit by a car or truck. Yet that’s exactly what happened on Folsom Boulevard in Sacramento around 9:30am on February 4, 2010. Shortly after a garbage truck and van collided, the truck went careening into a former gas station that’s been remodeled and converted into a children’s daycare center

Emergency personnel had to cut both the garbage truck and van drivers out of their demolished vehicles before the two could be examined. Although the van was killed, the truck driver was taken to a nearby hospital for treatment.

This horrible tragedy illustrates how dangerous road conditions and potentially inattentive drivers can combine to cause serious injury or damage. Our Sacramento Personal Injury Lawyers have been assisting victims of tragedies such as these for over 16 years. Our hearts go out to families of those children injured in this sad incident.
