A student of Beitzel Elementary School suffered major injuries on Thursday afternoon while he was run over by a FedEx truck as he was leaving the school.

The truck was in the front of Beitzel Elementary School at around 1:30 keeping the crosswalk blocked. While the delivery truck turned left onto westbound Chantal Way, the 10-year-boy ran onto the crosswalk. He ran directly into the truck and additionally ended up being pulled to the ground, after that was run over by the vehicles back wheels.

The victim was brought to UC Davis Medical Center having significant injuries, which include a broken pelvis. Sacramento accident remains under investigation.

However there may be other information that can influence who will be deemed responsible, in whole or in part, for a collision. California Vehicle Code section 21950 says: “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection”, and that a driver approaching a pedestrian within any marked or unmarked crosswalk “shall exercise all due care and shall reduce the speed of a vehicle or take any other action relating to the operating of the vehicle as necessary to safeguard the safety of the pedestrian.” Determining who is at fault in a pedestrian versus auto collision usually requires a very fact specific investigation that includes consideration of the speed of the vehicle, the visibility of the pedestrian, road conditions, and whether avoidance measures were taken.

The driver of a vehicle can be held legally liable for injuries to a pedestrian even if they were not in a cross walk at the time they were hit.
A Sacramento man suffered major personal injuries after he was struck by a car on Wednesday night. The accident occurred at about 8 p.m. at the intersection of Meadowview Road and Tamoshanter Way.

Based on the initial reports it is possible that the driver did not see the pedestrian. The victim was transported to the hospital in critical condition. This Sacramento injury accident remains under investigation.

California Highway Patrol records indicate that 14,047 pedestrians were injured by motorists in California in 2008. The injuries are often serious, and sometimes deadly, because of the force that a vehicle imparts to an exposed body.

In all pedestrian versus car collisions, witness accounts are essential.

Sacramento Personal Injury Lawyers

The driver of a vehicle can be held legally liable for injuries to a pedestrian even if they were not in a cross walk at the time they were hit. Pedestrians injured by a motor vehicle should seek the counsel of an experienced Sacramento Injury Attorney who will analyze all of the factors involved in an incident and will hold the negligent parties accountable. If roadway conditions were a factor, a public or governmental entity may have liability. It is important to consult with a California Personal Injury lawyer quickly since any claim against a public or governmental agency must be filed within 180 days of the accident or injury. An experienced personal injury attorney will advise injury victims of their rights, including whether they are entitled to recover medical expenses, lost income and pain and suffering as a result of the incident.

An explosion in Sonoma County injured four people Wednesday at the Redwoods Conference Grounds near Occidental. The explosion occurred when septic workers using a jackhammer created a spark that ignited methane in the septic system. One of the victims suffered third-degree burns and the others suffered first and second-degree burns. One victim also suffered an eye injury. Two of the victims were transported to Santa Rosa Memorial Hospital and the other two were taken to the Palm Drive Hospital in Sebastopol.

Work injuries can often present complicated legal issues. Most work injuries are covered by the workers’ compensation system that has its own set of rules. Under workers’ compensation, an employee is entitled under an insurance policy put in place by his or her employer to certain benefits including medical expenses, temporary disability for time missed from work, and permanent disability based on the extent of the injury. Workers’ compensation provides coverage regardless of who was at fault for causing the injury. In some situations, the workers’ compensation system is the “exclusive” remedy for the injured worker, meaning that the worker must accept what is offered by workers’ compensation and cannot sue his or her employer or a co-employee for civil damages.

California Personal Injury Attorneys

In some cases, however, a work injury accident gives rise to a liability claim against a “third-party”, that is, some person or entity other than the worker’s employer or co-employee. For instance, in the above scenario, if the septic workers were responsible for causing the explosion and worked for Company A, and one of the persons injured was someone at the worksite who worked for company B, the person working for Company B would have the right to sue Company A for civil damages in addition to making a workers’ compensation claim with Company B. If a bystander who was not on the job was injured, he would not have a workers’ compensation claim, but would still have the right to sue Company A.

The compensation an injured worker receives under a civil claim includes many things that cannot be recovered under a workers’ compensation claim, including pain and suffering, and can result in a much bigger recovery to the injured worker. Accordingly, a thorough investigation should be performed any time a worker is seriously injured on the job to determine who was entirely or partially at fault. Anyone seriously injured in a work accident should a qualified Northern California Personal Injury Attorney to investigate the case and determine all of the available legal options.

A Modesto sixth grader who was volunteering as a crossing guard sustained injuries on Tuesday morning when she was struck by a car in a crosswalk. The Modesto pedestrian accident occurred at approximately 8:30 a.m. while the girl was helping students cross Orangeburg Avenue on their way to Fremont Elementary School. The light for pedestrian traffic was green when a car traveling south on Tully Road attempted to turn east on Orangeburg Avenue and struck the girl, who was transported to a local hospital for evaluation of her injuries.

Drivers should exercise special caution when driving in areas, like schools, where pedestrians are present. California Highway Patrol records indicate that 14,047 pedestrians were injured by motorists in California in 2008. The injuries are often serious, and sometimes deadly, because of the force that a vehicle imparts to an exposed body.

An off duty California Highway Patrol officer suffered serious personal injuries when his motorcycle struck by a hit by a car in Northwest Fresno. Witnesses saw a silver Toyota Tundra driving erratically on east bound Herndon Avenue before it veered into the motorcycle and forced it off the roadway and into a curb. Police are looking for the driver of the Toyota, who fled the scene. The officer sustained a serious leg injury and was flown to a Bay Area Hospital to undergo surgery.

This Fresno injury collision remains under investigation, but it appears the driver of the Toyota bears complete responsibility for this collision. Some of the worst drivers are also the most irresponsible drivers. California law makes it a misdemeanor to leave the scene of a collision without stopping unless someone suffers serious bodily injury, in which case it becomes a felony. Despite these potential penalties, California Highway Patrol statistics indicate that 22,091 victims were injured in 2008 by irresponsible drivers who caused hit and run collisions.

Hit & Run Accidents, California Injury Law

Besides driving defensively, the best way to protect yourself against hit and run drivers is to have adequate uninsured motorist coverage in your own policy. If you are injured by someone driving a hit and run vehicle or an uninsured vehicle, the uninsured motorist coverage in your policy will pay for medical expenses, lost income and pain and suffering to the extent of the other driver’s liability. In the above scenario, the hit and run driver was legally liable for all of the damages sustained by the CHP officer but if the drive of the Toyota is not found, he may have to make a claim under the uninsured motorist coverage of his own motorcycle insurance policy.

Fresno Personal Injury Attorneys

If you or a loved one is injured or dies in a hit and run accident, you should consult with an experienced Fresno Personal Injury Attorney. In hit and run cases, law enforcement does not always have the time or resources to investigate and track down a hit and run driver. A knowledgeable Sacramento Personal Injury Lawyer can investigate and hold a hit and run driver responsible for his or her actions. A good California Auto Accident Attorney will advise you of all your rights with regard to a civil claim for damages and recovery under all available insurance policies.

Jimmy Rayes Hayes, 76, was killed Sunday in a head-on collision on Highway 20 in Yuba County. At about 10:50 pm Mr. Hayes’ 1999 Ford Explorer drifted across the center line of the highway near Timbuctoo Road and hit a Volkswagen Golf head on. Mr. Hayes’ vehicle then careened off the roadway and hit a tree.

Mr, Hayes was pronounced dead at the scene. His 76-year-old passenger Karen Line was taken to the hospital with cuts on both arms and head pain. The driver of the Golf, 47-year-old Tamara Yoneda of San Juan, reported pain in her jaw.

According to the police, all three victims were wearing seatbelts and both drivers were traveling below the city speed limit at the time. It does not appear that alcohol or drugs were involved, however, this California car accident remains under investigation.

Based on the available information, Mr. Hayes is more than likely responsible from a legal standpoint to compensate the victims of this California injury accident for all medical bills, lost income and pain and suffering. In most cases, Mr. Hayes’ insurance would pay for these losses even though he is deceased. If he had no insurance, the passengers may be able to recover under the uninsured motorist provision of an auto insurance policy covering their vehicle.

Anyone seriously injured in an auto accident has a number of serious issues to deal with after a collision like this. First, the legal responsibility for the collision must be determined. Sometimes that requires investigation beyond what is contained in the police report. Second, the medical bills must be paid. Even if there is health insurance to pay for the bills initially, the health insurance company will likely seek reimbursement from any liability insurance recovery. That means that the health insurance company will be competing for money that otherwise would go to the injured victim. Third, when there are multiple people injured in a crash, they will often be competing for a proportional share of a limited amount of insurance money. Lastly, insurance companies will do whatever they can to avoid paying fair compensation for not only medical bills, but lost income and pain and suffering as well.
