The driver of a Yuba Sutter garbage truck died Tuesday in a Marysville accident on Highway 20 after his truck crashed with a big rig. Yuba City resident Gary Wayne Mathis, 43, was pronounced dead at the scene. The driver of the big rig was transported to a local hospital with minor injuries. The cause of the accident is not known and this Marysville big rig accident remains under investigation.

Big Rigs represent a unique danger on our roadways. According to the National Highway Traffic Safety Administration (NHTSA), 5,374 people were killed during 1998 in collisions involving large trucks. In those fatal collisions, 86 percent of the victims were either occupants of the other vehicle or wee not in any vehicle. Because of their size, big-rigs represent an especially dangerous threat on the roadways. In many instances, the conduct of the big-rig driver and/or their employer can greatly increase the risk of the general motoring public. Statistics show that many of the big-rig collisions resulting in injury or fatality are caused in part by the following:

Truck driver             fatigue caused by driving long hauls while failing to comply             with minimum sleep and continuous driving regulations;

Use of drugs             by drivers to assist in driving long hours and for             recreation and failure to maintain an effective drug testing             program;

Failure to             maintain the tires, brakes and other mechanical conditions             of the tractors and trailers through minimum required             inspections;

Trucks with             loads that over the weight limit or that are subject to             shifting due to improper balance or lack of restraint;

Excessive             speeding and other driving violations often ignored by the             employer;

Lack of training and minimum experience requirements.

Truck driver             fatigue caused by driving long hauls while failing to comply             with minimum sleep and continuous driving regulations;

Lack of training and minimum experience requirements.

Unfortunately, the victims of a big-rig or truck collision or their families often have a difficult time obtaining fair compensation because they are dealing with commercial insurance carriers that got to great lengths to avoid payment of claims. Injured victims or the family of a deceased victim are urged to obtain the legal assistance of An experienced Personal Injury Attorney, who will investigate the causes of the collision, protect the injured person’s legal rights, and make sure that they receive adequate compensation for all of the consequences of their injuries.

Sacramento Trucking Accident Attorneys

Work injuries present a set of complicating factors to the claims process. Most work injuries are covered by the workers’ compensation system that has its own set of rules. Under workers’ compensation, an employee is entitled to certain benefits including medical expenses, temporary disability for time missed from work, and permanent disability based on the extent of the injury. These benefits are paid by insurance obtained by the employer. Workers’ compensation provides coverage regardless of who was at fault for causing the injury. In most situations, the workers’ compensation system is the “exclusive” remedy for the injured worker against his/her employer, meaning that the worker must accept what is offered by workers’ compensation and cannot sue his or her employer for civil damages.

In a situation where someone other than the employer is responsible for causing the injury, an injured worker is entitled to recover civil damages in addition to workers compensation benefits. The compensation an injured worker receives under a civil claim includes many things that cannot be recovered under a workers’ compensation claim, including pain and suffering, and can result in a much bigger recovery to the injured worker. Accordingly, a thorough investigation should be performed any time a worker is seriously injured on the job to determine who was entirely or partially at fault. Anyone seriously injured in a work accident should a qualified Northern California Personal Injury Attorney to investigate the case and determine all of the available legal options.

Three people suffered major injuries this morning when the SUV they were driving became disabled in the slow lane on northbound Highway 99 and was hit from behind by a big rig. The big rig plowed the SUV into a sound wall on the shoulder, crushing the SUV in the process. Two occupants of the SUV were ejected and a third person was trapped inside. All three victims of the Highway 99 accident were transported to the hospital in critical condition.

Although this California injury accident remains under investigation, the information available indicates that traffic had been backed up as a result of the disabled vehicle, and therefore the driver of the big rig would be primarily at fault for causing this collision by violation Vehicle Code §22350, driving at a speed that was unsafe for traffic conditions.

One person died and five were seriously injured Wednesday in a big rig accident on Highway 99 in Modesto. At approximately 1:50 p.m., a big rig traveling south bound failed to slow for traffic ahead and struck a Nissan Frontier from behind, triggering a five vehicle chain reaction collision. The male driver of the Nissan Frontier was pronounced dead at the scene. His female passenger was taken to a local hospital with major injuries. Four people in other vehicles also sustained injuries.

California Truck Accidents

Rear end collisions are the most common type of injury accident. Traveling at an unsafe speed or simply not paying attention are the most common causes. If the driver of a vehicle pays attention to traffic conditions, drives at a safe speed, and maintains a safe distance behind the vehicle ahead, these collisions are easily avoidable. In almost every situation, the vehicle that hits another vehicle from behind has violated California Vehicle Code §22350, and is legally responsible for causing the collision.

There is a common perception that these type of collisions are merely accidents, are forgivable, and that victims too often try to take advantage by claiming compensation for whiplash. However, the reality is that these collisions can and do cause major catastrophic injuries and, as this collision illustrates, death. This is especially true when the vehicle causing the rear end collision is a big rig.

According to the National Highway Traffic Safety Administration (NHTSA), 5,374 people were killed during 1998 in collisions involving large trucks. In those fatal collisions, 86 percent of the victims were occupants of another vehicle. Because of their size, big-rigs represent an especially dangerous threat on the roadways. In many instances, the conduct of the big-rig driver and/or their employer can greatly increase the risk to the general motoring public. Statistics show that many of the big-rig collisions resulting in injury or fatality are caused in part by the following:

Truck              driver fatigue caused by driving long hauls while failing to             comply with minimum sleep and continuous driving             regulations;

Use              of drugs by drivers to assist in driving long hours and for             recreation and failure to maintain an effective drug testing             program;

Failure              to maintain the tires, brakes and other mechanical             conditions of the tractors and trailers through minimum             required inspections;

Trucks              with loads that over the weight limit or that are subject to             shifting due to improper balance or lack of restraint;

Excessive              speeding and other driving violations often ignored by the             employer;

Lack of training and minimum experience requirements.

Truck              driver fatigue caused by driving long hauls while failing to             comply with minimum sleep and continuous driving             regulations;

Use              of drugs by drivers to assist in driving long hours and for             recreation and failure to maintain an effective drug testing             program;

Unfortunately, the victims and their families of a big-rig or truck collision often have a difficult time obtaining fair compensation, sometimes because the trucker is from out of state and the insurance company is an obscure commercial carrier with experience in avoiding payment of claims. Injured victims or the family of a deceased victim are urged to obtain the legal assistance of an experienced California Personal Injury Attorney who will investigate the causes of the collision, protect the rights of injured person or of the deceased’s family, and make sure that they receive adequate compensation for all of the consequences of the collision. .

The drivers of a Sacramento County transit bus and a big rig were seriously injured in a Sacramento auto accident and San Joaquin County auto accident that occurred on State Route 12 near Isleton around 4:40 p.m. on Monday. According to the California Highway Patrol, the big rig was headed west bound at an unknown rate of speed when it encountered traffic, attempted to slow down and jackknifed. Thetransit bus, which was not carrying passengers, was traveling east bound when it collided with the out of control big rig. The driver of the bus was transported by life flight to the U.C. Davis Medical Center and the big rig driver was taken to John Muir hospital in the Bay Area, both with major injuries.

This California auto collision also involved a red Chevy Blazer which swerved and went down an embankment to avoid the collision. Reports indicated that the occupants of the Blazer were not seriously injured.

The California big rig accident remains under investigation. It is not reported that alcohol and drugs were involved.

Although this California big rig injury accident is still under investigation, it appears that the driver of the big rig was at fault for operating her truck at a speed that was unsafe for the prevailing traffic conditions, a violation of Vehicle Code §22350. Big-rigs have the potential to be especially dangerous to the general motoring public. The conduct of the big-rig driver and/or their employer can greatly increase the risk of causing a collision and injuries. Statistics show that many of the big-rig collisions resulting in injury or fatality are caused in part by the following:

Truck              driver fatigue caused by driving long hauls while failing to             comply with minimum sleep and continuous driving             regulations;

Failure              to maintain the tires, brakes and other mechanical             conditions of the tractors and trailers through minimum             required inspections;

Trucks              with loads that over the weight limit or that are subject to             shifting due to improper balance or lack of restraint;

Excessive              speeding and other driving violations often ignored by the             employer;

Lack of training and minimum experience requirements.

Unfortunately, the victims of a big-rig or truck collision often have a difficult time obtaining fair compensation, sometimes because the trucker is from out of state and the insurance company is an obscure commercial carrier with experience in avoiding payment of claims. Injured victims or the family of a deceased victim are urged to obtain the legal assistance of a Personal Injury Attorney, who will investigate the causes of the collision, protect the injured person’s legal rights, and make sure that they receive adequate compensation for all of the consequences of their injuries.

Three people were injured in a Sacramento car accident on Tuesday’s afternoon on westbound Highway 50 near Sunrise Boulevard.

An elderly couple was driving in the slow lane when a car traveling at a higher speed came up behind them. The 19 year-old driver of the vehicle that came upon the elderly couple realized at the last moment that he was to close to the vehicle. As a result, the 19-year-old driver lost control, swerved back and forth and hit the vehicle with the elderly couple. Both cars rolled over.

Based on the initial Police statements, three injured people were taken to the UC Davis Medical Center.

We hope that no one sustained major personal injuries in this car accident. We wish all a fast and complete recovery.

California Auto Accidents

Based on the California Highway Patrol Integrated Traffic Records System there were 241,873 injured victims in all types of collisions in 2008.

Although the Sacramento car accident is under the investigation, it appears that excessive speed played an important factor California Vehicle Code §22350 says that you must drive at a speed that is safe for the conditions, and this is a kind of default rule that is routinely cited by investigating officers when writing a police report for this type of accident. Based on the preliminary investigation, it is likely the negligent 19-year-old driver will be held liable for this injury accident.

Hiring a Reputable Sacramento Personal Injury Attorney

In such a case a knowledgeable Sacramento Personal Injury Attorney will be able to advise all injured victims their legal rights and all options. The experienced lawyer will thoroughly analyze the cause of the collision, obtain witness statements, investigate the scene to protect the injured victims and insure the responsible party is held accountable.

With so many lawyers running radio, TV and Internet ads about their services, it can be difficult to determine which attorney is best suited to represent you. Keep in mind, your most critical goal is to find a Sacramento personal injury lawyer who has a lengthy and successful track record, coupled with excellent communication skills.

Although the following list of criteria can apply to many different types of lawyers, several of the suggestions directly apply to personal injury attorneys who represent numerous auto accident clients each year.

First, ask your various friends and business acquaintances to see if anyone you know has a specific attorney they can suggest based on firsthand experience;

Next, make sure you choose a law firm that specializes in personal injury cases, particularly those involving auto accidents;

Find out if the attorney you might hire helps to train other lawyers in your community about personal injury cases, perhaps by conducting seminars or speaking at professional conferences;

Ask whether or not the firm has a strong trial reputation, as well as a proven ability to negotiate high settlement amounts with insurance companies;

Check to be sure the law firm can afford to finance your case, even if it requires a lengthy trial;

Check with the State Bar of California to make sure your attorney has a good reputation within the legal community;

Make sure your lawyer introduces you (at an early stage) to each member of the legal team who will be interacting with you the most — to be sure you feel comfortable working with each individual;

Be sure to choose a lawyer who tells you how often you’ll be updated about the status of your case and who will usually provide you with that information;

Make sure you understand how your attorney’s fees and court costs will be handled; Find out if the firm’s percentage of the recovery (plus costs and expenses) may change, depending on whether or not it’s necessary to take your case to trial. Ask questions about how any hired experts will be paid and how the firm will determine what you will receive, if the firm wins damages for you;

Make sure your initial consultation is free and that your lawyer will not charge you any fees “up front” – or later, if the firm fails to win your case;

Ask how long your lawyer thinks it may take to either settle your case or take it to trial. (It’s best to assume the longer time estimate will be the accurate one);

If your initial conversations with the attorney (and his or her staff) are not comfortable and pleasant ones, consider looking for another firm;

Make sure your attorney gives you a “ballpark” idea of what a case like yours is sometimes worth – if it settles or goes to trial. Keep in mind that there’s no guarantee that your case will be won. Be willing to accept an estimated range of possible recovery amounts.

If you’re able to obtain satisfactory information about all of these concerns, you have probably selected an excellent personal injury attorney. Just be sure you both sign a contract that clearly outlines all of the most pertinent information.
